Terms & Conditions

1. The offer

“Play & Earn” is a promotional game run by Pengwin Solutions (“Pengwin”, “we”, “us”), Hyderabad, India. In the game you collect virtual ₹ coins; the total collected in a run becomes a discount (the “Discount”) on a new project with Pengwin. Coins are virtual, have no cash value and exist only inside the game.

2. Who can take part

Individuals aged 18 or over and businesses based in India. Pengwin employees and their immediate families cannot claim a Discount. Existing Pengwin clients cannot register their existing business.

3. Entering and playing

Each entry needs a completed form with accurate details and a business name. Each business name can be entered once.
Each entry gives you one run. The amount you collect in that run is that entry's Discount. Leaving or reloading the page during a run ends it, and the amount collected so far counts.
You may play again by submitting a new entry with a different business name. Your contact details may be the same.
There is no upper limit on what a single run can collect, but see the limits in section 5.

4. Receipts and claiming your Discount

After your run you receive a Receipt ID (for example PE-12345-AB7KQ), shown on screen and emailed to you. To claim, contact us within 90 days of the receipt date and quote the Receipt ID. We verify it against our records and may confirm your identity and business by calling your registered number. The Discount applies to the quoted price of a new project for the service you chose (or another service, at our discretion), agreed within that period.

5. Limits

One Receipt per project. Receipts cannot be combined, split or added together.
A Discount cannot exceed the value of the project it is applied to.
Receipts are non-transferable, cannot be exchanged for cash or credit, and cannot be used with any other offer.
A Receipt can only be claimed by the registered contact, for the business named on it.

6. Fair play

Entries made with bots, scripts or automation; by tampering with the game, its code or its network requests; with fake or someone else's details; or with invented or duplicate business names are void. We may disqualify entries, cancel Receipts and refuse claims where we reasonably suspect misuse. Our decision on eligibility and validity is final.

7. Offer period and changes

This is a limited-time promotion. We may change, pause or end the offer or these terms at any time. Receipts issued before the offer ends stay valid for their 90-day claim period, under the terms in force when they were issued.

8. Liability

The game is provided “as is”. We are not responsible for connection, device or browser problems that affect a run, and re-runs for technical issues are at our discretion. To the extent the law allows, our total liability in connection with the offer is limited to the value of the Discount on the Receipt concerned.

9. Law

These terms are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction.

Privacy notice

What we collect

Details you give us: name, phone number, email, business name and the service you're interested in.
Game results: the amount collected, run status, Receipt ID and the date and time.
Technical data, for fraud and bot prevention: IP address; a device identifier stored in a cookie (pe_did) and in your browser's storage; and a summary of your browser and device (browser, operating system, screen size, time zone) with a one-way hash of browser characteristics.

Why we use it

To run the game, issue and email your Receipt, and verify and apply your Discount.
To keep the offer fair: detecting bots, automation, tampering and duplicate business names.
To contact you about your Discount and our services. You can ask us to stop marketing messages at any time.

Your consent

We process this data on the basis of the consent you give when you tick the box on the entry form, in line with India's Digital Personal Data Protection Act, 2023. You can withdraw consent at any time by emailing us; withdrawing consent may mean we can no longer honour an unclaimed Receipt.

Cookies and browser storage

The pe_did cookie (up to 400 days, renewed when you visit) and matching browser-storage entries hold a random device identifier used only for fraud and bot prevention and to remember your game session. They contain no personal details. Clearing your browser's site data removes them.

Sharing

We do not sell your data. We share it only with service providers who host our website and database and send our emails, under confidentiality obligations, or where the law requires it.

How long we keep it

For the duration of the offer plus 12 months, then we delete or anonymise it. If you become a client, we keep what we need for that relationship and our legal obligations.

Your rights

You can ask to access, correct or delete your data, withdraw consent, or raise a grievance by emailing hello@pengwinsolutions.com. We aim to respond within 30 days. See also our main Privacy Policy.
